The Media is advised that criminal charges are merely accusations and
that this defendant is presumed innocent until and unless proven guilty.Jackson Police Department, along with the Ocean County Prosecutor's
Office, is seeking those organizations in Jackson Township, who believe that they would
qualify for release of information relative to Megans Law. In order to qualify for
notification, organizations must meet certain criteria and file a Community Organization
Application. Only organizations with supervisory control over children and those who care
for women, would be entitled to notification or information relative to known sex
offenders who meet certain criteria. Schools and licensed day care providers are
automatically included on the list of organizations to be considered for notifications.Pursuant to the law, organizations must register with the local police
and determination will be made by the Prosecutors Office as to which groups qualify
for notification under the law. The statute also mandates three levels of notification depending upon
the degree of risk of re-offense. Risk Categories are as follows:Low Risk - Tier OneModerate Risk - Tier TwoHigh Risk - Tier ThreeThe Prosecutors Office determines, subject to approval by a
Superior Court Judge, the tier which an offender belongs. The scope of community
notification (to whom notice is given) is dependent upon the tier in which the offender is
placed. Tier One - Notification is given only to local law enforcement. Law
enforcement agencies are include in all tiers. Schools are not included in Tier One
notifications.Tier Two - Notification is given to schools and registered community
organizations which have direct supervision over children and/or women and which have been
determined to be "likely to encounter" the particular offender.Tier Three - In addition to the notice given for tier two offenders,
notice must also be given to members of the general public who are "likely to
encounter" the particular offender.The County Prosecutors Office determines the specific schools,
community organizations and residences to receive notification. Those decisions are also
subject to judicial review.
