Chairman, Scott Najarian called the meeting to order at 8:07P.M., with a salute to the flag.  Attorney Greg McGuckin read the Open Public Meeting Act Statement.

Mr. Megill stated as per court settlement applicant is to amend the square footage of the single family dwelling to be 2,700.  Attorney Whitney Curtis representing the applicant stated the client

 

 

agreed to resize the proposed dwelling and will comply with the review letter.  Engineer, Mike B. Intile with Crest Engineering duly sworn explained the original plan and the proposed changes.

Public Portion.  Marion Ravalioli, 4 Mackentash Court, is pleased with the new proposal.

1.             APPLICANT: MICHAEL KELLY

LOCATION: 391 MEADOWOOD ROAD

 

Mr. Megill stated applicant is seeking a variance to construct a 8’x12’ shed 4’ from his side yard where 15’ is required. Michael Kelly duly sworn explained he has two sheds, one is back yard on tree line 3’ from neighbors property line and has been there for 4 years. He also explained the shed on the left side is on a concrete pad and he made a buffer of landscape plantings around it. He explained he could not move the shed closer to the house due to the building code. Public Portion.  James Celidonio- 395 Meadowood Road, duly sworn explained he has no problem with one of the sheds, but he has signed a complaint for the second shed. He is worried about the drainage and his children play in his yard near the shed he is concerned that animals could stay under it.   After much discussion Michael Kelly agreed to take the shed off the concrete blocks and put it on a slab and will add more plantings. Mr. Megill stated applicant is seeking a variance to construct a 6’ solid fence in their front yard on this corner lot.  Brian Burton duly sworn explained there is an empty space between the neighbor’s fence and his driveway and would like to utilize that space.   Jeromie Lange suggested that the fence be placed parallel to the house. 3.             APPLICANT: MICHAEL & KELLY TRIOLA

Mr. Megill stated applicant is seeking a variance to construct an above ground pool 6’ from their side yard where 20’ is required and construct a 6’ solid fence in their front yard on this corner lot.  Michael Triola duly sworn explained he wants the pool for his family he has 6 and 10 year old children. He will stay out of the sight triangle and be 20’ in from street.  No objection from the public. 4.             APPLICANT: DOMINIC PONDACO

                LOCATION: 6 POPLAR STREET

 

Mr. Megill stated applicant is seeking a variance to construct a detached garage in their front yard on this corner lot. Dominic Pondaco duly sworn explained wants garage for his cars.  He is converting his existing garage into a mother-daughter living space. Mr. Megill stated that he will have to do a deed restriction for the mother-daughter.  No objection from the public. Mr. Megill stated applicant is seeking a 1year time extension for use variance #1923 with prior subdivision approval per resolution 2002-28. Atty. Ray Shea representing applicant explained why the delay with development due to the MUA. Engineer, Charles Boyle with Flanner, Webb, duly sworn discussed the approval received from Lakewood Twp. 6.             APPLICANT: SAM BAUMAN 

                BLOCK: 120.01         LOT: 65         ZONE: R-3

                LOCATION: 73 STURM LANE

 

Mr. Megill stated applicant is seeking a variance to construct a single family dwelling on this lot where the lot frontage required is 100’ and is providing 30’. Henna Bauman- 115 10th street Lakewood, NJ duly sworn.  Mr. Megill explained the road ends at property so there us no other way to access but with a variance.  Atty. Ray Shea explained the applicant wants to build one home on five acres.  Public Portion.  George Zatrinski- 59 Sterm Lane, duly sworn looked at the proposed plans and has no objection with the proposal.  Lauren French- 52 Sturm Lane, duly sworn explained she lived there for 17 years and saw the original home burn.  She has concerns for fire.  Jeromie Lange explained they will meet the emergency access requirements.  Tommy French- 52 Sturm Lane, has issue with the frontage of the home. 7.             APPLICANT: HAL HVIDSTEN(LIMO LINE)

                BLOCK: 111           LOT: 1.02 & 2  ZONE: HC

                LOCATION: N. COUNTY LINE ROAD

 

Mr. Megill stated applicant is seeking a variance for the existing dwelling to remain as such along with the right to use dwelling as a commercial vehicle rental and car sales business.  Atty. Ray Shea explained he was not aware of taxes delinquent and will take care of.  Mr. Megill explained that the issue of violations has been dismissed by the courts.  Mr. Shea discussed the business operation and hours. Hal Hvidsten duly sworn discussed the purchase of the property and the purchase of 30’ by the county with the previous owner along County Line Road.  Bill Stevens of Property Development Services stated he was not aware of the 30’ sold to the County when he designed the plans.  Greg McGuckin requested the plans be revised and submitted before being heard.  Mr. Shea asked for the application to be carred to the January 15, 2003 meeting, no notice required. 8.             APPLICANT: LAURA LOBIANCO

                BLOCK: 139.02                  LOT: 22 & 25                      ZONE: R-3

                LOCATION: GENOVA AVENUE

               

Mr. Megill stated applicant is seeking a variance to construct a single family dwelling where the lot depth required is 400’ and is providing 200’ also a variance is required to allow an existing structure to remain in its present location which is in the front yard along with a lot consolidation.  Laura Lobianco duly sworn.  Atty John Doyle discussed the variances requested.  Scott Najarian requested a deed restriction that the property could not be subdivided in the future except to sell some property to lot 21 to make is more conforming.  Engineer, Chuck Lindstrom duly sworn discussed the proposed plans and existing building to be used as a garage for personal use. No objection from the public.  Motion to approve by: ZIOBRO/PanequeKELLY/Hampton YES: Hampton, Kelly, Paneque, Weinstein, Sheeran and Najarian. VARIANCE  GRANTED WITH STIPULATIONS

9.             APPLICANT: JOSEPH SERRATELLI

                BLOCK: 82.01        LOT: 20.01       ZONE: R-3

                LOCATION: 50 BUTTERFLY ROAD

 

Mr. Megill stated applicant is seeking a variance to construct a single family dwelling in the R-3 Zone and is proposing one side yard of 15’ where 50’ required and the other side yard proposed at 30’ where 50’ required, also 3 acre required and providing 1 acre.  Joseph Serratelli duly sworn.  Atty. Richard Maser representing the applicant described the surrounding area and variances requested.  Joseph Serratelli described the proposed home of 3,500 to 3,700 sqft. He also explained he presently lives in Jackson and wants to keep his kids in the same school. The Buy/Sell letter discussed.  No objection from the public.  Motion to approve by SHEERAN/Weinstein YES: Hampton, Kelly, Paneque, Weinstein, Sheeran & Najarian.  VARIANCE GRANTED

 

10(13).   APPLICANT: THERESA DANTONIO

                BLOCK: 120.01           LOT: 70           ZONE: R-3

                LOCATION: 975 BENNETTS MILLS ROAD

 

Mr. Megill stated applicant is seeking a use variance to utilize the existing dwelling as a dental office with a residential apartment. Also Dr. Toma had approvals for a chiropractic office and to live in the dwelling.  Theresa Dantonio duly sworn.  Atty Ray Shea representing the applicant stated they want to withdraw the proposal for the apartment and use the building for only business.  Ms. Dantonio explained her proposal and would be in the office only about three to four times a week, she also has a mobile dental business.  Engineer, Charles Gilligan duly sworn discussed the employee parking, dental lab and patron parking.  The applicant is only requesting the use variance and will come back with a site plan for approval in the future.  No objection from the public.  Motion to approve by KELLY/Weinstein YES: Hampton, Kelly, Paneque, Weinstein, Sheeran & Najarian. USE VARIANCE APPROVED.

The next meeting of the Zoning Board of Adjustment will be January 8th 2003 for Re-Organization at 8:00 pm. in the Municipal Building.  The Next Regular Meeting of the Zoning Board of Adjustment will by January 15th 2003 at 7:30 pm. in the Municipal Building.
